Section 11-92C-2 Definitions. For the purposes of this chapter, the following words have the following meanings: (1) APPLICANT. A natural person who files a written application with the governing body of any authorizing subdivision in accordance with Section 11-92C-3. (2) AUTHORITY. Any local redevelopment authority organized pursuant to this chapter. (3) AUTHORIZING RESOLUTION. A resolution adopted by the governing body of any authorizing subdivision in accordance with Section 11-92C-3, which authorizes the incorporation of the authority. (4) AUTHORIZING SUBDIVISION. Any county or municipality that has adopted an authorizing resolution. (5) BOARD. The board of directors of an authority. (6) BONDS. Any bonds, notes, certificates, or any other form of indebtedness representing an obligation to pay money. (7) CONTIGUOUS. Section 11-3A-2 Powers for public welfare, health, and safety; authorization; scope. (a) Except where otherwise specifically prohibited or provided for either heretofore or hereafter by general law or the constitution of this state and subject to the procedures and limitations set out in this chapter, the county commission of a county may provide for its property and affairs; and for the public welfare, health, and safety of the citizens throughout the unincorporated areas of the county by exercising certain powers for the protection of the county and public property under its control. Section 11-54B-8 Costs of supplemental services; assessment of classes; exemptions. (a) A self-help business improvement district ordinance shall provide that all costs of the supplemental services provided in a business improvement district will be financed through the levy of a special assessment on the owners of the real property located within the geographical area of the district and shall designate the method set forth in the plan as the method which will be used to determine the amount of such special assessment in a manner which fairly and equitably distributes the burden of financing the supplemental services among the real property owners in the district.
