Section 11-44C-8 Mayor - Majority vote requirements; run-off election. The candidate for mayor
receiving the largest number of votes for the office shall be elected thereto, provided such
candidate receives a majority of all votes cast for such office. If at the first election
no candidate received a majority of the votes cast for the office, then another election shall
be held upon the same day of the week three weeks thereafter to be called and held in the
same mode and manner and under the same rules and regulations. In the second election there
shall be two candidates for the office of mayor; and these candidates shall be the two who

more of the qualified electors of such city, asking that the proposition of the adoption of
the mayor-council form of government for such city be submitted to the qualified voters thereof,

Section 11-43-2 Election of mayors and aldermen; exercise of legislative functions; salary
of aldermen. (a) Except as provided in subsection (c), in all cities and towns at the general
election to be held on the fourth Tuesday in August, 1984, and quadrennially thereafter, there
shall be elected a mayor, who, in cities having a population of 12,000 or more according to
the last or any subsequent federal census, shall not sit with the council nor have a vote
in its proceedings, and he or she shall have the power and duties conferred in this chapter.
(b) In all cities and towns having a population of less than 12,000 inhabitants according
to the last or any subsequent federal census, the legislative functions shall be exercised
by the mayor and five aldermen. The mayor shall preside over all deliberations of the council.
