Section 45-37A-52.60 City clerk. If the city clerk of any city which adopts the mayor-council form of government holds office subject to any civil service or merit system, such clerk shall continue to be the city clerk under the mayor-council form of government of such city, and his or her successor shall be selected and hold office subject to the provisions of such civil service or merit system. If the city clerk of any city which adopts the mayor-council form of government does not hold office subject to any civil service or merit system, the council shall elect the city clerk. Section 45-49A-80.01 Vacancies. Whenever a vacancy occurs in the office of mayor in the City of Prichard in Mobile County, Alabama, with six months or more remaining in the vacating mayor's term, the president of the city council shall immediately instruct the city clerk to provide for holding a special election to fill such vacancy with such election to be held no later than 60 days after such office has become vacant. Such election shall be held in the manner prescribed by law and the person elected to the office of mayor in such special election shall serve for the remainder of the unexpired term.
