Section 45-46-90.01 Definitions. (a) Wherever used in this article, unless a different meaning clearly appears in the context, the following terms and others evidently intended as the equivalent thereof, shall be given the following respective interpretations: (1) APPLICANT. A natural person who files a written application with the governing body of Marengo County, or with the governing body of any municipality in such county in accordance with Section 45-46-90.02. (2) AUTHORITY. A public corporation organized pursuant to this article. (3) AUTHORIZING COUNTY. Marengo County, Alabama, provided the governing body thereof shall have adopted an authorizing resolution. (4) AUTHORIZING MUNICIPALITY. Section 24-1-24 Composition of authority; compensation of commissioners; quorum; officers and employees; delegation of powers and duties by authority. (a) Except as provided in subsection (b), an authority shall consist of five commissioners appointed by the mayor, who shall designate the first chair. (a) In order to provide funds for the benefit of the public schools in Marshall County, the Marshall County Commission is hereby authorized to levy and to provide for the assessment and collection of any sales and use taxes generally paralleling the state sales and use taxes in Marshall County or in any portion thereof as hereinafter provided, which tax or taxes shall be in addition to any and all other county taxes heretofore or hereafter authorized by law in Marshall County.
