Section 11-43A-83 Powers of council; president and president pro tem. The council shall be
the governing body of the municipality and shall exercise all legislative functions of the
municipality. All powers of the municipality, including all powers vested by this article,
by the constitution and by the general and local laws of this state, and the determination
of all matters of policy, shall be vested in the council. Without limitation of the foregoing,
the council shall have the power to appoint and remove the city manager, to establish other
administrative departments of the municipality and to promulgate rules and regulations for
the operation of such departments. The council shall have the power to override any veto of
the mayor relating to ordinances and resolutions of a general and permanent nature by an affirmative

Section 11-44D-1 Ordinance abandoning commission form of government and referendum adopting
mayor-council or manager-council form. Within three months of the adoption and approval of
this chapter, the governing body of any Class 6 municipality with a commission form of government
may by a majority vote of the members of that governing body adopt an ordinance abandoning
the commission form of government and calling for a referendum to be held at public expense
within 60 days after such call for the purpose of determining whether such city shall adopt

Section 11-43-85 Appointment, etc., of accountant, etc., to conduct examination and prepare
report as to municipal books and accounts. In cities and towns, the mayor, at least once a
year, shall appoint an independent public accountant or the Department of Examiners of Public
Accounts to conduct an examination in accordance with generally accepted auditing standards

Section 11-43B-4 Conduct of elections; residency requirements; qualifying fee; statement of
