Section 17-15-3 Special elections ordered by Governor. All special elections provided for by this chapter are to be ordered by the Governor, who must issue writs of election, directed to the judge of probate of the counties in which such election is required to be held and must specify therein the district or county in which, and the day on which, such election is to be held; the cause and object of the same; the name of the person in whose office the vacancy has occurred and, in all cases in which a special election is directed in a district composed of more than one county, such election must be directed to be held on the same day in each county. Section 45-45-70 Adoption of laws and codes; inspectors; fees. (a) In Madison County, the county commission shall adopt building laws and codes by ordinance which shall apply to all commercial or industrial improvements in the county. The building laws and codes of the county commission shall not apply to any municipality which is enforcing its building code and law within the corporate limits of the municipality without the express consent of the municipality. Section 45-49-91.04 Certification of petition. The judge of probate, with assistance from the revenue commissioner of the county, shall certify the accuracy of the petition within 30 days of receipt in his or her office. If the accuracy of the petition cannot be certified, the judge of probate shall return the petition to the person or persons submitting it to the probate court, and shall notify the persons submitting the petition of the reason or reasons for returning the petition and that no election will be called.
