Section 45-42-162.08 Elections. The metropolitan-government shall be governed by a commission of nine part-time members and a full-time mayor. The election for the first officers of the metropolitan-government shall be held on the date established by the judge of probate. Before such election the governing body of the municipalities and the county shall cause the metropolitan area to be divided into nine districts containing as nearly as possible an equal number of people. The division of the metropolitan-government into districts shall be by a committee appointed as follows: Three persons appointed by the Limestone County Commission; two persons appointed by the Athens City Commission; two persons by a committee of mayors from the four incorporated cities; one person appointed by the Limestone County School Board; and one person appointed by the Athens City School Board. Section 33-17-2 Legislative intent; construction of chapter. The Legislature hereby makes the findings of facts and declaration of intent hereinafter set forth in this section. The construction of a navigable waterway between Demopolis, Alabama and the Tennessee River, utilizing the channel of the Tombigbee River, would provide a new transportation route of great importance and would stimulate the development of commerce, agriculture and industry in many sections of the state. Local flooding along the tributary streams of the Tombigbee River occurs frequently in the growing and harvesting season and causes considerable damage to agriculture in the affected sections of the state. Improvements in the channels of the tributary streams will eliminate much of the damage caused by flooding and will also permit improved farming practices and better land use. Section 45-39A-50 Local option election authorized for sale and distribution of alcoholic beverages. (a)(1) The Legislature of Alabama is cognizant of Opinion of the Justices No. 376, 825 So. 2d 109 (Ala. 2002), which states on page 115 that a local bill for Cherokee County "purporting to allow by local law the creation of a traffic in alcohol that does not presently exist in smaller municipalities in Cherokee County, does not fit within the ambit of the last paragraph of Section 104 permitting the Legislature to pass local laws regulating or prohibiting such traffic." (a)(1) Notwithstanding any rule adopted by the board, the board may issue an entertainment district designation to any retailer licensee that is licensed to sell alcoholic beverages for on-premises consumption and to any manufacturer licensee that conducts tastings or samplings on the licensed premises, provided the licensees are located in an entertainment district established pursuant to this section. Section 11-46-4 Identification of electors eligible to vote; municipality, county contracts; official poll list. (a) The incorporated municipalities of this state are hereby authorized to enter into contracts with the counties of this state and their boards of registrars to conduct an identification program of electors eligible to vote in municipal elections. Section 11-51-90 Municipal business licenses; branch offices; application. (a) All municipalities shall have the following powers: (1) To license any exhibition, trade, business, vocation, occupation, or profession not prohibited by the Constitution or laws of the state which may be engaged in or carried on in the municipality.
