Section 11-22-5 Certificate of incorporation - Filing and recording. When executed and acknowledged
in conformity with Section 11-22-4, the certificate of incorporation shall be filed with the
judge of probate of the county. The judge of probate shall thereupon examine the certificate
of incorporation and, if he finds that the recitals contained therein are correct, that the
requirements of Section 11-22-4 have been complied with and that the name is not identical
with or so nearly similar to that of another corporation already in existence in this state
as to lead to confusion and uncertainty, he shall approve the certificate of incorporation
and record it in an appropriate book or record in his office. When such certificate has been
so made, filed, and approved, the applicants shall constitute a public corporation under the

Section 11-88-20 Validation of prior defective incorporations under provisions of article.
In all cases where there has heretofore been an attempt to incorporate a public corporation
under the provisions of this article, and a certificate of incorporation with respect to such
corporation has been filed in the office of the judge of probate of the county in which such
corporation was sought to be incorporated, but the attempted incorporation is invalid because
of some irregularity in the procedure followed, the attempted incorporation of such public
corporation with respect to which such a certificate of incorporation has been filed shall
be and hereby is validated ab initio, notwithstanding any irregularity in the procedure for

Section 15-18-179 Application for incorporation; certificate of incorporation; amendment; board
of directors; dissolution; funding; competitive bidding laws not applicable. (a) A public
corporation may be organized as a community punishment and corrections authority pursuant
to this article in any county or group of counties located in one or more judicial circuits.
