proclaimed by the Governor or by the President of the United States, the provisions of the
federal Uniformed Services Employment and Reemployment Rights Act (USERRA) apply to any active
member of the Alabama National Guard, or a member of the national guard of another state who
is employed in the State of Alabama and called or ordered to state active duty or federally
funded duty for other than training. Under USERRA, a person who is a member of, applies to
be a member of, performs, has performed, applies to perform, or has an obligation to perform
service in the uniformed services may not be denied initial employment, reemployment, retention
in employment, promotion, or any benefit of employment by an employer on the basis of that

1 04-FEB-20 SYNOPSIS: Under existing law, state contracts for goods and services in excess
of $15,000 are generally required to be let to the lowest responsible bidder, although a state
agency may award a contract to a preferred vendor, as defined, if the bid is not more than
five percent greater than that of the lowest responsible bidder who is not a preferred vendor.
This bill would establish a preference for bidders on state contracts which are geographically
disadvantaged business enterprises and would require state contracts for goods or services
to be let to geographically disadvantaged business enterprises if the bid is within three
percent of the lowest responsible bid. This bill would require the Department of Finance to

expand the act to require recordation of satisfaction to include mortgages securing commercial
agricultural properties and would rename that act the "Alabama Residential and Agricultural

of the Board of Pardons and Paroles has violated a condition of parole, other than being arrested
or convicted of a new offense or absconding, the parole court may recommend and the board
may impose a term of confinement of no more than 45 days. Also under existing law, a parolee
may spend time in holding prior to the board imposing a term of confinement for a violation
of a condition of parole. This bill would provide that a parolee shall receive a reduction
of the term of confinement imposed by the board for time spent in holding, pending the imposition
of the period of confinement. This bill also would apply retroactively to any person currently
