11-FEB-16 SYNOPSIS: Existing law provides for the crimes of cruelty to animals and aggravated
cruelty to animals. This bill would increase the penalties for those crimes under certain
conditions and would require a person convicted under certain conditions to undergo a psychological
evaluation and attend counseling. This bill would also create the crime of animal abandonment
and would provide penalties. Amendment 621 of the Constitution of Alabama of 1901, now appearing
as Section 111.05 of the Official Recompilation of the Constitution of Alabama of 1901, as
amended, prohibits a general law whose purpose or effect would be to require a new or increased
expenditure of local funds from becoming effective with regard to a local governmental entity
without enactment by a 2/3 vote unless: it comes within one of a number of specified exceptions;

of education are required to develop and implement local policies and procedures requiring
the one-year expulsion of students who have brought to school or have in their possession
a firearm in a school building, on school grounds, on school buses, or at other school-sponsored

appropriate manner on a case-by-case basis and would prohibit any local board of education

of the present or future value of retirement benefits of a person to his or her spouse upon
divorce if the parties have been married for at least 10 years and if certain other conditions
are met. Under existing law, when the court orders an allowance of retirement benefits of
one spouse to another upon divorce, no amount is payable until the covered spouse begins to
receive benefits unless the parties agree to a lump sum settlement. This bill would eliminate
the requirement that the parties have been married for 10 years before the court may award
retirement benefits. This bill would allow the court to use any equitable method of valuing,
dividing, or distributing to benefits, but the noncovered spouse could receive no more than
