and powers of the districts. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:Section 1. Section
35-8B-1, 35-8B-2, and 35-8B-3, Code of Alabama 1975, are amended to read as follows: §35-8B-1.
"(a) "Community development district" shall mean a private residential development
that: (1) Is a size of at least 250 acres of contiguous land area; (2) has at least 100 residential
sites, platted and recorded in the probate office of the county as a residential subdivision;
(3) has streets that were or will be built with private funds; (4) has a social club with:
(i) an 18-hole golf course of regulation size; (ii) a restaurant or eatery used exclusively
for the purpose of preparing and serving meals, with a seating...

fiscal year basis. Recently, the federal government has changed certain filing dates for federal
income tax returns. This bill would provide for the due dates of state income tax returns
to correspond to the due dates for federal returns. The bill would also further provide for

of a common law marriage. This bill would codify the elements required by case law to establish
the existence of a common law marriage-capacity and would specify that the parties could prove
the existence of a common law marriage by proving the existence of each element by clear and
convincing evidence. This bill would also provide that the parties to a common law marriage
could prove the marriage by filing a properly executed declaration of common law marriage
in the probate office. This bill would establish the required contents of the declaration.
