of the state as defined in Section 36-26-10, Code of Alabama 1975, and all other state employees
and hourly employees of the state, except those set out in Section 3, and all legislative
personnel, officers, and employees, whether subject to the state Merit System or not, and
all employees of the county health departments who are employed subject to the state Merit

may appoint up to three deputy directors of transportation, one of whom may be the chief engineer,
with the approval of the Governor. The Director of Transportation may assign duties and responsibilities
to a deputy director as may be necessary for the proper administration and execution of the
