in the Judicial Retirement Fund of Alabama if they have the requisite years of creditable
service. Amendment 621 of the Constitution of Alabama of 1901, now appearing as Section 111.05
of the Official Recompilation of the Constitution of Alabama of 1901, as amended, prohibits
a general law whose purpose or effect would be to require a new or increased expenditure of
local funds from becoming effective with regard to a local governmental entity without enactment
by a 2/3 vote unless: it comes within one of a number of specified exceptions; it is approved

SYNOPSIS: Under existing law, a collection fee is added to the total amount of funds due for
court-ordered restitution after a matter has been transferred to the district attorney for
collection purposes. Under existing law, the total amount of the collection fee is distributed
to the district attorney and the circuit clerk before any other distributions to a victim
or victims or any other entity are made. This bill would provide for a pro rata distribution
of the total amount collected by the district attorney, the Unified Judicial System, and the
circuit clerk for court-ordered restitution and other fines and court costs including the

to locate a fugitive, would revise the procedures and time frames for the forfeiture of bail,
