164766-1:n:02/20/2015:FC/th LRS2015-489 SB44 By Senator Holtzclaw RFD Transportation and Energy Rd 1 03-MAR-15 SYNOPSIS: Under existing law, the Legislature has delegated its legislative authority relating to charges for photo driver's licenses and photo nondriver identification cards to the Department of Public Safety, now a part of the Alabama Law Enforcement Agency, subject to certain standards provided in the law. The Alabama Law Enforcement Agency increased various fees for the licenses effective February 9, 2015, without following the rulemaking procedures of the Alabama Administrative Procedure Act. This bill would specify that setting any charge to the public for issuing the driver's licenses or cards would be subject to the Alabama Administrative Procedure Act. The bill would also specify that this action is declaratory of existing law and would be retroactive to February 9, 2015.
