Under existing law, except for certain driving under the influence offenses, a municipal court
may only impose a sentence of imprisonment not to exceed six months. This bill would allow
a municipal court to sentence persons to imprisonment not to exceed one year if the offense
is a Class A misdemeanor. Amendment 621 of the Constitution of Alabama of 1901, now appearing
as Section 111.05 of the Official Recompilation of the Constitution of Alabama of 1901, as
amended, prohibits a general law whose purpose or effect would be to require a new or increased
expenditure of local funds from becoming effective with regard to a local governmental entity
without enactment by a 2/3 vote unless: it comes within one of a number of specified exceptions;

SYNOPSIS: Under existing law, a classified employee under the State Merit System may demand
a public hearing by the State Personnel Board if he or she is dismissed from employment by
an appointing authority. This bill would revise the procedures for review of the dismissal
and would specify when the board may reverse or modify the dismissal. This bill would also
provide that any action commenced for the purpose of seeking judicial review of the administrative
decisions of the State Personnel Board must be filed in the Alabama Court of Civil Appeals.
