Under existing law, sodomy in the first degree requires forcible compulsion or that the victim possess a mental defect or be physically helpless, or the perpetrator be more than 16 years of age and the victim less than 12 years of age. Under existing law, a person under age 16 is incapable of consent. Under existing law, one circumstance in which a person commits the crime of sexual misconduct is when he or she engages in deviate sexual intercourse with another person under circumstances not covered by sodomy in the first degree or sodomy in the second degree, and consent is not a defense to prosecution under this circumstance regardless of...
