SB111 By Senator Orr ENROLLED, An Act, To establish the Alabama Transportation Infrastructure
Bank; to specify the membership, powers, duties, terms, sources for capitalization, and liability
of the bank; to provide for the redistribution of a portion of gasoline tax revenues and motor
vehicle registration fee revenues; to provide procedures for the issuance of loans and other
financial assistance to certain government entities for certain qualified projects; to provide
authority for the bank to issue certain bonds under certain conditions; to require the bank
to report annually to the Governor and the Legislature. BE IT ENACTED BY THE LEGISLATURE OF
ALABAMA: Section 1. This act shall be cited as the Alabama Transportation Infrastructure Bank
Act. Section 2. For the purposes of this act, the following words shall have the following
meanings: (1) BANK. The Alabama Transportation Infrastructure Bank. (2) BOARD. The board of

of Alabama 1975; to authorize the Department of Transportation to enter into various types
of construction agreements and financing agreements for construction of a public road, bridge
or tunnel, and work related or incidental thereto, under the jurisdiction of the Department
of Transportation; and to require the Department to develop an evaluation process and procedures
for selecting public road, bridge and tunnel projects under these provisions. BE IT ENACTED
BY THE LEGISLATURE OF ALABAMA:Section 1. Section 23-1-40 of the Code of Alabama 1975, is amended
to read as follows: ยง23-1-40. "(a) It shall be the duty of the State Department of Transportation
to designate the roads to be constructed, repaired, and maintained and to construct, standardize,
repair, and maintain roads and bridges of this state; and it shall have authority to make

of Transportation to enter into various types of construction agreements and financing agreements
with other public and private entities for constructing a public improvement and repairing
its buildings, offices, and other facilities. This bill would require the department to develop
a process for evaluating and selecting public improvement projects under these provisions.
