The determination of a district attorney, or the district attorney's designee, that a person is engaging in or assisting in the medical use of cannabis in accordance with the provisions of this act shall be deemed to be evidenced by the following: (1) A decision not to prosecute. (2) The dismissal of charges. (3) Acquittal. Section 12. For the purposes of medical care, including organ and tissue transplants, a qualified patient's authorized use of cannabis shall be considered the equivalent of the authorized use of any other medication used at the direction of a physician and may not constitute the use of an illicit substance.
