SYNOPSIS: This bill would propose a local amendment to the Constitution of Alabama of 1901, relating to the City of Birmingham, to provide for the salary and expenses of the city council.

A BILL TO BE ENTITLED AN ACT

Proposing an amendment to the Constitution of Alabama of 1901, relating to the City of Birmingham; to provide for the salary and expenses of the members of the city council.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:Section 1. The following amendment to the Constitution of Alabama of 1901, is proposed and shall become valid as a part of the Constitution when all requirements of this act are fulfilled:

PROPOSED AMENDMENT

Section 1. The annual salary for each member of the City Council of the City of Birmingham shall be set and adjusted each regular four-year term by the State Personnel Board, by determining the median household income of the city rounded up to the nearest thousand, to take effect on the first day of January of each new term.

Section 2. (a) In addition, all members of the City Council of the City of Birmingham shall receive ten thousand dollars ($10,000) per year for expenses incurred during the performance of official duties. No member of the council of any Class 1 municipality may receive additional reimbursement for any expenses except as provided in this section.

(b) In addition to subsection (a), each member of the city council may be reimbursed for any expenses incurred for official travel or other official business outside of the city in the same amounts or at the same rates as for employees of the city for travel outside of the city traveling in the service of the city under existing law. Any reimbursement under this subsection, to the extent possible, shall mirror similar rules applicable to reimbursement of employees of the city.

(c) The President of the City Council of the City of Birmingham may not discriminate between members of the council body regarding the timely reimbursement of authorized expenses.

Section 3. (a) The salary and expenses provided in Sections 1 and 2 shall constitute the total amounts payable to the presiding officers and members of the city council, beginning with the term commencing immediately after any municipal election in 2017.

(b) The City Council of Birmingham may not increase, supplement, or otherwise enlarge the compensation or reimbursement for expenses payable to its members pursuant to this amendment.

Section 2. An election upon the proposed amendment shall be held in accordance with Amendment 555 to the Constitution of Alabama of 1901, now appearing as Section 284.01 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

"Proposing an amendment to the Constitution of Alabama of 1901, relating to the City of Birmingham, to provide for the salary and expense allowance of the members of the city council.

"Proposed by Act _________"

This description shall be followed by the following language:

"Yes ( ) No ( )."
