SYNOPSIS: Under existing law, in Mobile County, the office of the license commission and the office of the revenue commission function as separate offices.

This bill proposes a local amendment to the Constitution of Alabama of 1901, to abolish the office of the license commission and transfer all authorities, duties, equipment, fees, functions, funds, responsibilities, and staff of the license commission. In addition, this bill provides that the county commission shall continue to provide sufficient funds and office space for the newly expanded office.

A BILL TO BE ENTITLED AN ACT

Relating to Mobile County; to propose a local amendment to the Constitution of Alabama of 1901, to abolish the office of license commission and transfer all authorities, duties, equipment, fees, functions, funds, responsibilities, and staff of the license commission to the office of revenue commission; and to provide that the county commission shall continue to provide sufficient funds and office space for the newly expanded office.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:Section 1. The following amendment to the Constitution of Alabama of 1901, is proposed and shall become valid as a part of the Constitution when all requirements of this act are fulfilled:

PROPOSED AMENDMENT

(a) Effective on the first day of the second month after approval by a majority of the qualified electors voting and certification of the election results, the office of License Commissioner of Mobile County is abolished. All control, exercise, and possession of the authorities, duties, equipment, fees, functions, funds, responsibilities, and staff currently authorized to the office of the license commissioner, including but not limited to, by any act, amendment, constitution, law, ordinance, resolution, or statute, regardless if the authority is presently being acted upon, shall transfer to the Revenue Commissioner of Mobile County.

(b) The revenue commissioner shall retain all control, exercise, and possession of the authorities, duties, equipment, fees, functions, funds, responsibilities, and staff currently authorized to the office of the revenue commissioner, including but not limited to any act, amendment, constitution, law, ordinance, resolution, or statute, regardless if the authority is presently being acted upon.

(c) On the effective date, the Office of License Commissioner is abolished.

(d) The revenue commissioner may appoint and fix the duties of up to three additional persons to serve as the revenue commissioner sees fit.

(e) The county commission shall continue to provide sufficient funds and office space to accommodate the expanded functions of the office of revenue commission.

Section 2. An election upon the proposed amendment shall be held in accordance with Amendment 555 to the Constitution of Alabama of 1901, now appearing as Section 284.01 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

"Relating to Mobile County, proposing an amendment to the Constitution of Alabama of 1901, to abolish the office of license commissioner and transfer those authorities, duties, equipment, fees, functions, funds, responsibilities to the revenue commissioner.

"Proposed by Act _________"

This description shall be followed by the following language:

"Yes ( ) No ( )."
