SYNOPSIS: Under existing law, a valid nonresident hunting license is required for a nonresident of the State of Alabama to hunt in this state. Also under existing law, the Alabama Department of Conservation and Natural Resources has the authority to enter into a reciprocal agreement with the State of Florida exempting persons 65 years of age or older from state fishing and hunting license requirements.

This bill would allow the commissioner of the department to enter into a reciprocal agreement with any state to allow a nonresident person 65 years of age or older to hunt in this state without a nonresident hunting license if the person possesses a valid hunting license from his or her own state of residence.

A BILL TO BE ENTITLED AN ACT

To amend Section 9-11-53.3 of the Code of Alabama 1975, relating to reciprocal agreements with Florida exempting persons age 65 or older from state fishing and hunting licensing requirements; to further allow the Commissioner of the Department of Conservation and Natural Resources to enter into a reciprocal agreement with any state to allow a nonresident person 65 years of age or older to hunt in this state if the person has a valid hunting license in his or her own state of residence.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:Section 1. Section 9-11-53.3 of the Code of Alabama 1975, is amended to read as follows:

ยง9-11-53.3.

"(a) It is the intent of the Legislature that the State of Alabama Department of Conservation and Natural Resources enter into a reciprocal agreement with the State of Florida exempting persons 65 years of age or older from state fishing and hunting license requirements.

"(b) In addition to subsection (a), the commissioner of the department may enter into a reciprocal agreement with any state to allow a nonresident person 65 years of age or older to hunt in this state without a nonresident hunting license, as provided for in Sections 9-11-46 to 9-11-49, inclusive, if the nonresident person possesses a valid hunting license from his or her own state of residence."

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
