Body: | Section 12-2-38 Forfeiture by district attorney failing to perform duties required by Sections 12-2-34 and 12-2-35. Any district attorney who fails, without sufficient excuse, to perform any of the duties required of him under Sections 12-2-34 and 12-2-35, shall forfeit to the State of Alabama $100.00, to be recovered by the Attorney General, on motion, in the circuit court of Montgomery County on 10 days' notice.
