ENROLLED, An Act,

To alter, rearrange, and extend the boundary lines and corporate limits of the Town of Brilliant in Marion County to remove certain property from the corporate limits of the town.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. The boundary lines and corporate limits of the Town of Brilliant in Marion County are altered and rearranged and to remove from the corporate limits of the town all of the following territory:

Parcel 1

An 18 acre, more or less, tract of land situated in the East 1/2 (E1/2) of Southeast 1/4 (SE1/4) of Section 17, Township 12 South, Range 12 West, Marion County, Alabama and being more particularly described as follows "Beginning at the purported southwest corner of the Southeast 1/4 (SE1/4) of Southeast 1/4 (SE1/4) of Section 17, Township 12 South, Range 12 West, said corner being marked by a pipe, thence run N.03°43'19"W., along the westerly boundary of the above said E1/2 of SE1/4, a distance of 1500 feet, more or less, to the center of Dickinson Creek, to a point; thence run S. 67°6'38"E., along the meander of said creek a distance of 100.12 feet, to a point; thence continue along the meander of the center of said creek, S. 31°49'14"E., a distance of 560.00 feet, to a point; thence run S.89°47'46"E., a distance of 372.40 feet, more or less, to the westerly right-of-way of Marion County Highway Number 61, to a 1/2 rebar, thence run in a southwesterly direction along the westerly right-of-way of said highway, along the arc of a curve to the right having a radius of 2751.15 feet, a delta angle of 15°16'30", an arc distance of 733.45 feet, a chord bearing of S.03degrees19'35"W., a chord distance of 731.28 feet, to the point of tangency,- thence continue along the westerly right-of-way of said highway, S.11°01'58"W., a distance of 246.13 feet, to its intersection with the southerly boundary of the above said SE1/4 of SE1/4, to a 1/2 inch rebar; thence run S.89°00'33"W., along the southerly boundary of said SE1/4 of SE1/4, a distance of 573.41 feet, to the point of beginning."

Parcel 2

That part of the East half of the Southeast 1/4 of Section 17, T12S, R12W, Marion County, Alabama described as follows: Commence at the Southwest corner of the Southeast Quarter of the Southeast Quarter for a point of beginning; thence N3°43'19”W, along the West line of said East Half, 1998.14 feet to an iron pin at the 'Northwest corner of the South Half of the Northeast Quarter of the Southeast Quarter; thence N88°45'19"E, along the North line thereof, 560.'25 feet to an iron pin on the West right-of-way of County Highway 61; thence S14°28'07"E, 'along said right-of-way, 189.09 feet to a point; thence S16°13'18"E, along said right-of-way, 122.06 feet to a point; thence S16°47'09"E., along said right-of-way, 142.32 feet to a point; thence S15°27'47"E, along said right-of-way, 110.54 feet to a point; thence S12°12'34"E, along said right-of-way, 156.35 feet to a point; thence S9°05'46"E, along said right-of-way, 212.21 feet to a point; thence S5°25'55"E, along said right-of- way, 178.50 feet to a point; thence S1°31'19"E, along said right-of-way, 129.09 feet to a point; thence along said right-of-way, S1°56'10"W, 232.41 feet to a point; thence S5°43'56"W, along said right-of-way, 129.99 feet to a point; thence S8°18'48"W, along said right-of-way, 142.51 feet to a point; thence S10°57'50"W, along said right-of-way, 286.60 feet to an iron pin on the South line of said Southeast Quarter of the Southeast Quarter; thence S89°00'33"W, along said South line, 573.41 feet to the point of beginning. The above described parcel contains 30.52 acres, more or less.

Parcel 3

A 4.0 acre, more or less, tract of land, situated in the South 1/2 of (S1/2) Northeast 1/4 (NE1/4) of Southeast 1/4 (SE1/4) of Section 17, Township 12 South, Range 12 West, Marion County, Alabama and being more particularly described as follows: Commence at the southwest corner of the Southeast 1/4 (SE 1/4) of Southeast 1/4 (SE1/4) of Section 17, Township 12 South, Range 12 West, said corner being marked by a pipe, thence run N.03°43'19"W., along the westerly boundary of the above said E1/2 of SE1/4, a distance of 1500 feet, more or less, to the center of Dickinson Creek to the point of beginning of the tract of land herein described, to-wit; thence run S.67 degrees 36'38"E., along the meander of said creek, a distance of 100.12 feet, to a point; thence run N.38°28'20"E., a distance of 699.16 feet, more or less, to the westerly right-of-way of Marion County Highway Number 61 and the northerly boundary of the South 1/2 of Northeast 1/4 of southeast 1/4, to a point, thence run S.88°45'22"W., along the northerly boundary of said S1/2 of NE 1/2 of SE1/4, a distance of 560.01 feet, more or less, to the northwest corner of mentioned S1/2 of SE1/4 of SE1/4, to a 1/2 inch rebar,- thence run S.03°43'19"E., along the westerly boundary of said S1/2 of NE1/4 of SE1/4, a distance of 498.14, more or less, feet. to the point of beginning.

Parcel 4

A 9.1 acre, more or less, tract of land situated in the South 1/2 (S1/2) of Northeast 1/4 (NEl/4) of Southeast 1/4 (SEl/4) of Section 17, Township 12 South, Range 12 West, Marion County, Alabama, being more particularly described as follows: "Beginning at the southeast corner of the NE1/4 of SE1/4 of said Section 17, thence run S.88degrees 52'56"W., along the southerly boundary of said NE1/4 of SE1/4, a distance of 532.70 feet, to the easterly right-of-way of Marion County Highway number 61, to a point; thence run the following consecutive chord bearings and distances along the easterly right-of-way of said highway, (N.12degrees 00'25"W., a distance of 139.80 feet; N.15degrees 27'47"W., a distance of 113.74 feet; N.16degrees 47'09"W, a distance of 142.85 feet; N.l6degrees l3'l8"W., a distance of 120.62 feet; N.14degrees 32'18"W., a distance of 168.94 feet) to the Northerly boundary of the S1/2 of NEl/4 of SE1/4 to a point; thence run N.88degrees 45'l9"E., along the northerly boundary of said S1/2 of NEl/4 of SEl/4, a distance of 672.51 feet, to the northeast corner of mentioned S1/2 of NEl/4 of SEl/4, to a point; thence run S.03degrees 10'40"E., along the easterly boundary of said S1/2 of NEl/4 of SE1/4, a distance of 667.72 feet, to the point of beginning.

Parcel 5

Tract 2

All that part Of the Southeast 1/4 of the Southeast 1/4 and that part of the South half of the Northeast 1/4 of the Southeast 1/4 of Section 17, T12S, R12W, Marion County, Alabama that lies East of County Highway 61 described as follows: Commence at the Southeast corner of the Southeast Quarter of the Southeast Quarter for a point of beginning; thence along the South line thereof, S 89 degrees 00'33"W, 640.76 feet to the East right-of-way of County Highway 61; thence N 10 degrees 57'50"E, along said right-of-way, 271.51 feet to a point; thence N 8 degrees 18'48"E, 146.16 feet to a point, thence along said right-of-way, N 5 degrees 43'56"E, 134.44 feet to a point; thence N 1 degree 56'l0"E, along said right-of-way 237.47 feet to a point; thence N 1 degree 31'19" W, along said right-of-way, 134.23 feet to a point thence N5 degrees 25'55"W, along said right-of-way, 183.79 feet to a point; thence N 9 degrees 05'46"W, along said right-of-way, 216.94 feet to a point; thence N 12 degrees l2'34"W, along said right-of-way, 160.80 feet to a point; thence N 15 degrees 27'47"W, along said right-of-way, 113.74 feet to a point; thence N 16 degrees 47'09"W, along said right-of-way, 142.85 feet to a point; thence N 16 degrees 13'l8"W, along said right-of-way, 120.62 feet to a point; thence N 14 degrees 32' 18"W, along said right-of-way, 168.94 feet to a point on the North line of the South Half of the Northeast 1/4 of the Southeast 1/4; thence N 88 degrees 45'19"E., 672.51 feet to the Northeast corner of said North Half; thence S 3 degrees 10'40"E, along the East line of said Section 17, 2003.15 feet to the point of beginning. The above described parcel contains 25.65 acres.

Tract 3

All that part of the NE 1/4 of NE 1/4 of Section 20, Township 12 South, Range 12 West, Marion County, Alabama, which lies East of the road, LESS AND EXCEPT the following described tract conveyed to the State of Alabama as recorded at Deed Book 325, Page 18, to-wit: "Commencing at the Southeast corner of the NE 1/4 of the NE 1/4 of Section 20, T12S, R12W: thence westerly along the south line of said NE 1/4 of the NE 1/4 a distance of 148 feet, more or less, to the point of beginning of the property herein to be conveyed, said point being on a line which extends from a point that is 225 feet northeasterly of and at right angles to the centerline of Project No. APD-471(12) at Station 309+00 to a point that is 260 feet northeasterly of and at right angles to said centerline at Station 304+00; thence northwesterly along said line a distance of 62 feet, more or less, to said point that is 260 feet northeasterly of and at right angles to said centerline at Station 304+00; thence northeasterly along a line, perpendicular to said centerline, a distance of 90 feet; thence N 64 degrees 59'43"W, parallel with said centerline, a distance of 910 feet, more or less, to the present southeast right-of-way line of County Road No. 61; thence southwesterly along said present southeast right-of-way line a distance of 515 feet, more or less, to the south line of said NE 1/4 of the NE 1/4, the south property line: thence easterly along said south property line a distance of 1078 feet, more or less, to the point of beginning. Said strip of land lying in the NE 1/4 of NE 1/4 of Section 20, Township 12 South, Range 12 West, containing 6.66 acres, more or less."

Section 2. In accordance with Section 11-42-6(b) of the Code of Alabama 1975, a map showing what territory is proposed territory to be removed from the Town of Brilliant is on file and open to public inspection in the office of the Judge of Probate in Marion County, Alabama, and the map is open to the inspection of the public.

Section 3. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
