SYNOPSIS: This bill would extend access to facilities owned by the Alabama National Guard to certain veterans and their caregivers who do not now have access to those facilities.

A BILL TO BE ENTITLED AN ACT

Relating to the Alabama National Guard; to extend access to facilities owned by the Alabama National Guard to certain veterans and their caregivers.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. As used in this act, the following terms shall have the following meanings:

(1) MEDAL OF HONOR RECIPIENT. The same meaning as provided in Section 1074H(c) of Title 10 of the United States Code and its successor, if any.

(2) VETERAN. The same meaning as provided in Section 101 of Title 38 of the United States Code and its successor, if any.

(3) FORMER PRISONER OF WAR. The same meaning as provided in Section 101 of Title 38 of the United States Code and its successor, if any.

(4) SERVICE-CONNECTED. The same meaning as provided in Section 101 of Title 38 of the United States Code and its successor, if any.

(5) CAREGIVER. The same meaning as provided in Section 1720G(d) of Title 38 of the United States Code and its successor, if any.

(6) FAMILY CAREGIVER. The same meaning as provided in Section 1720G(d) of Title 38 of the United States Code and its successor, if any.

Section 2. In addition to all other benefits, the following persons shall be permitted to use the facilities owned by the Alabama National Guard on the same basis as a member of the United States Armed Forces who is entitled to retired or retainer pay:

(1) A veteran who is a Medal of Honor recipient.

(2) A veteran who was awarded the Purple Heart.

(3) A veteran who is a former prisoner of war.

(4) A veteran with a service-connected disability.

(5) A caregiver or a family caregiver of a veteran.

Section 3. The Adjutant General of the Alabama National Guard is authorized to adopt rules necessary to implement this act.

Section 4. Nothing in this act is deemed to limit the authority of the Alabama National Guard to control access to locations or facilities in order to maintain security and good order.

Section 5. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
