HB493

ENROLLED, An Act,

Relating to Monroe County; to provide for an additional court cost in cases in the circuit and district courts; and to provide for the distribution of the proceeds of the additional court costs.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. This act shall apply only in Monroe County.

Section 2. In addition to any court costs now authorized in the district, circuit, and juvenile courts of Monroe County, there shall be assessed and collected an additional court cost of ten dollars ($10) in all civil and criminal cases, including traffic cases in the district, circuit, and juvenile courts of the county.

Section 3. The additional court costs shall be paid to the Monroe County Commission and shall be earmarked for security at the Monroe County Courthouse.

Section 4. Nothing in this act shall impair the authority of a circuit or district judge to waive or to remit the court costs and fees assessed pursuant to this act upon the sworn and valid showing of substantial financial hardship.

Section 5. It is the intent of the Legislature that the assessment and collection of the additional court costs pursuant to this act not diminish or take the place of any other source of funds for the office of the presiding circuit judge.

Section 6. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
