SYNOPSIS: Under existing law, reduced speed school zones exist along state-maintained roads and highways that are near school property.

Also under existing law, certain municipalities, by local law, have authorized the use of photographic speeding enforcement systems or automated speed enforcement systems within the municipalities.

This bill would prohibit the use of a photographic speeding enforcement system or automated speed enforcement system within a reduced speed school zone while the school for which the school zone is designated is not in session.

A BILL TO BE ENTITLED AN ACT

Relating to reduced speed school zones; to prohibit the use of a photographic speeding enforcement system or automated speed enforcement system within a reduced speed school zone while the school for which the school zone is designated is not in session.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) As used in this section, the following terms have the following meanings:

(1) PHOTOGRAPHIC SPEEDING ENFORCEMENT SYSTEM or AUTOMATED SPEED ENFORCEMENT SYSTEM. A camera system that is designed and installed to work in conjunction with an electronically operated speed detection device synchronized to automatically record digital imaging of a motor vehicle that exceeds the posted speed limit. The device is capable of producing at least one recorded image which is capable of clearly depicting the license plate of the motor vehicle that is speeding.

(2) REDUCED SPEED SCHOOL ZONE. As defined in Section 32-5A-181.

(b) A photographic speeding enforcement system or automated speed enforcement system may not be used to enforce a school zone speed limit in a reduced speed school zone while the school for which the reduced speed school zone is designated is not in session, including, but not limited to, Saturday, Sunday, school holidays, and spring or summer breaks.

(c) A speeding ticket issued in violation of this section shall be void.

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
