SYNOPSIS: Under existing law, the costs related to furnishing and maintaining an administrative office of a city board of education are funded by local and state funds.

This bill would provide that all costs related to the administrative office of a city board of education established on or after the effective date of the act must be funded by the municipality and may not be funded by any state funds.

A BILL TO BE ENTITLED AN ACT

Relating to city school districts; to add Section 16-11-28 to the Code of Alabama 1975; to provide that all costs related to the administrative office of a city board of education must be funded by the municipality and may not be funded by any state funds.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. Section 16-11-28 is added to the Code of Alabama 1975, to read as follows:

ยง16-11-28.

(a) This section does not apply to any municipality whose governing body, before July 1, 2020, adopted an ordinance or resolution establishing a city board of education.

(b) A municipality that establishes a city board of education on or after July 1, 2020, shall be responsible for all costs and expenses, whether startup or ongoing, related to the central administrative office of the city board of education, including, but not limited to, all of the following:

(1) Capital costs, including rent, debt repayment, improvements, and maintenance costs.

(2) Salaries and other expenses of the superintendent, administrators, and support staff.

(3) Supplies and equipment.

(c) The city board of education may not use or divert any state funds to pay any portion of the costs and expenses related to the central administrative office.

(d) Nothing in this section prohibits a city board of education from using federal funds to pay costs and expenses related to the central administrative office.

Section 2. This act shall become effective on July 1, 2020, following its passage and approval by the Governor, or its otherwise becoming law.
