SYNOPSIS: Existing local laws authorize certain municipalities to use automated traffic enforcement systems to detect red light and speeding violations.

This bill would prohibit the use of automated traffic enforcement systems and would repeal all local laws authorizing the use of automated traffic enforcement for red light or speeding violations.

A BILL TO BE ENTITLED AN ACT

Relating to automated traffic enforcement; to prohibit the use of automated traffic enforcement systems; to repeal all local laws authorizing the use of automated traffic enforcement for red light or speeding violations, including: Part 3, commencing with Section 45-24A-32, of Article 3 of Chapter 24A of Title 45, Code of Alabama 1975; Part 2, commencing with Section 45-37A-331, of Article 33 of Chapter 37A of Title 45, Code of Alabama 1975; Article 4, commencing with Section 45-41A-41, of Chapter 41A of Title 45, Code of Alabama 1975; Article 4, commencing with Section 45-37A-42, of Chapter 37A of Title 45, Code of Alabama 1975; Article 10, commencing with 45-37A-100, of Chapter 37A of Title 45, Code of Alabama 1975; Article 1, commencing with 45-21A-10, of Chapter 21A of Title 45, Code of Alabama 1975; and Act 2009-740 of the 2009 Regular Session, Acts 2011-298 and 2011-337 of the 2011 Regular Session, Act 2010-711 of the 2010 Regular Session, Act 2012-326 of the 2012 Regular Session, and Act 2016-117 of the 2016 Regular Session.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) For purposes of this section, the term "automated traffic enforcement system" means any camera system that is designed and installed to record violations of traffic safety laws. The term includes, but is not limited to, a system capable of producing at least two recorded images, at least one of which is capable of clearly depicting the license plate of a motor vehicle that is in violation of traffic law. The term also includes, but is not limited to, a system that may work in conjunction with an electronically operated traffic-control device using vehicle sensors synchronized to automatically record, either by conventional film or digital imaging, sequenced photographs or full motion video of the rear of a motor vehicle while proceeding through a signalized intersection, or in conjunction with an electronically operated speed detection device synchronized to automatically record digital imaging of a motor vehicle while speeding.

(b) An automated traffic enforcement system may not be used by the state, a county, a municipality, any of their instrumentalities, or any other political subdivision of the state to enforce traffic laws.

Section 2. All local laws authorizing the use of an automated traffic enforcement system are repealed, including, but not limited to, the following:

(1) Part 3, commencing with Section 45-24A-32, of Article 3 of Chapter 24A of Title 45, Code of Alabama 1975, relating to the City of Selma.

(2) Part 2, commencing with Section 45-37A-331, of Article 33 of Chapter 37A of Title 45, Code of Alabama 1975, relating to the City of Midfield.

(3) Article 4, commencing with Section 45-41A-41, of Chapter 41A of Title 45, Code of Alabama 1975, relating to the City of Opelika.

(4) Article 4, commencing with Section 45-37A-42, of Chapter 37A of Title 45, Code of Alabama 1975, relating to the City of Bessemer.

(5) Article 10, commencing with 45-37A-100, of Chapter 37A of Title 45, Code of Alabama 1975, relating to the City of Center Point.

(6) Article 1, commencing with 45-21A-10, of Chapter 21A of Title 45, Code of Alabama 1975, relating to the City of Brantley.

(7) Act 2009-740 of the 2009 Regular Session, Acts 2011-298 and 2011-337 of the 2011 Regular Session, and Act 2016-117 of the 2016 Regular Session, relating to the City of Montgomery.

(8) Act 2012-326 of the 2012 Regular Session, relating to the City of Phenix City.

(9) Act 2010-711 of the 2010 Regular Session, relating to the City of Tuscaloosa.

Section 3. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
