A BILL TO BE ENTITLED AN ACT

To make a supplemental appropriation from the Education Trust Fund Advancement and Technology Fund to the public institutions of higher education in the amount of $15,089,140 and to the Department of Education, the Board of Trustees of the Alabama Institute for Deaf and Blind, the Board of Youth Services School Districts, the Board of Directors of the Alabama School of Fine Arts, and the Board of Trustees of the Alabama School of Math and Science in the amount of $41,297,782 for the fiscal year ending September 30, 2017.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. In addition to all other appropriations heretofore or hereafter made, there is hereby appropriated a total of $15,089,140 from the Education Trust Fund Advancement and Technology Fund to the public institutions of higher education for the fiscal year ending September 30, 2017. This appropriation shall be expended for: (1) repairs or deferred maintenance of facilities for public education purposes in the state; (2) insuring facilities; or (3) the acquisition or purchase of education technology and equipment, or both. This appropriation shall be distributed as follows:

Section 2. In addition to all other appropriations heretofore or hereafter made, there is hereby appropriated a total of $41,297,782 from the Education Trust Fund Advancement and Technology Fund to the Department of Education, the Board of Trustees of the Alabama Institute for Deaf and Blind, the Board of Youth Services School Districts, the Board of Directors of the Alabama School of Fine Arts, and the Board of Trustees of the Alabama School of Math and Science for the fiscal year ending September 30, 2017. This appropriation shall be expended for: (1) repairs or deferred maintenance of facilities for public education purposes in the state; (2) classroom instructional support pursuant to 16-13-231(b)(2)c and Section 16-13-231.3; (3) insuring facilities; (4) transportation pursuant to Section 16-13-233; or (5) purchase of education technology and equipment or both.

Section 3. (a) The funds appropriated herein to the local school systems shall be allocated as follows with fifty percent (50%) of the funds allocated to systems that have not provided devices, wireless connectivity, or train the trainer:

(b) Notwithstanding any other laws to the contrary, the funds appropriated to the Department of Education by subsection (a) of this section shall not be expended without prior approval of the State Superintendent of Education.

Section 4. This act shall become effective immediately upon its passage and approval by the Governor, or upon its otherwise becoming law.
