SYNOPSIS: Under existing law, the Department of Corrections is authorized to purchase equipment, raw materials, and supplies necessary for the manufacture or production of prison-made goods.

This bill would provide that the Department of Corrections is authorized to make such a purchase without going through state purchasing.

A BILL TO BE ENTITLED AN ACT

To amend Section 14-7-8, Code of Alabama 1975, relating to purchases by the Department of Corrections for the manufacture or production of prison-made goods; to exempt the Department of Corrections from the purchasing through the Division of Purchasing of the Department of Finance.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:Section 1. Section 14-7-8, Code of Alabama 1975, is amended to read as follows:

ยง14-7-8.

"(a) The Alabama Board Department of Corrections is authorized to purchase in the manner prescribed by law, equipment, raw materials, components, and supplies and to engage the supervisory personnel necessary to establish and maintain for this state at the a penitentiary or any a penal farm or institution now or hereafter under the control of said board industries for the utilization of services of prisoners in the manufacture or production of such articles or products as may be needed for the construction, operation, maintenance or use of any office, department, institution or agency supported in whole or in part by this state and the political subdivisions thereof.

"(b) Purchases of equipment, raw materials, components, and supplies by the Alabama Department of Corrections for the manufacture or production of prison-made goods pursuant to subsection (a) are exempt from purchasing through the Division of Purchasing of the Department of Finance."

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
