SYNOPSIS: This bill would provide for the issuance of a distinctive Alabama Retired Law Enforcement Officer license plate.

This bill would provide for an annual additional fee of fifty dollars to be collected for each distinctive license plate issued, for the design of the distinctive license plate, and for the distribution of the net proceeds to the Alabama State Lodge Fraternal Order of Police and the Alabama Peace Officer's Annuity and Benefit Fund.

A BILL TO BE ENTITLED AN ACT

Relating to motor vehicles; to provide for the issuance of a distinctive Alabama Retired Law Enforcement Officer license plate; to provide for the design of the license plate; to provide for an additional annual fee; and to provide for the distribution of the net proceeds.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) Notwithstanding the provisions of Section 32-6-64, Code of Alabama 1975, upon application to the judge of probate or license commissioner, compliance with motor vehicle registration and licensing laws, payment of regular fees required by law for license plates for private passenger or pleasure motor vehicles, and payment of an additional annual fee of fifty dollars ($50), owners of motor vehicles who are residents of Alabama and retired law enforcement officers shall be issued distinctive Alabama Retired Law Enforcement Officer license plates. For the purposes of this act, the term retired law enforcement officer shall include a retired state, county, municipal, or federal law enforcement officer including a correctional officer. Proof that the applicant is a retired law enforcement officer shall be shown by a retired law enforcement officer identification card or badge.

(b) Plates issued under this section shall be valid for five years, and may then be replaced with either conventional, personalized, or new Alabama Retired Law Enforcement Officer plates.

(c) Payment of required license fees and taxes for the years during which a new plate is not issued shall be evidenced as provided in Section 32-6-63, Code of Alabama 1975.

(d) The Board of Directors of the Alabama State Lodge Fraternal Order of Police shall design, or have designed, the plate, which design shall be approved by the Commissioner of Revenue. Section 32-6-54, Code of Alabama 1975, shall not apply to the plates designed pursuant to this section.

(e) The plates shall be issued, printed, and processed like other distinctive and personalized plates provided for in Chapter 6 of Title 32, Code of Alabama 1975.

(f) The annual additional fee for the motor vehicle license plates shall be distributed in accordance with Section 32-6-68 of the Code of Alabama 1975, and as further provided herein. The net proceeds from the additional revenue shall be distributed as follows: The Alabama State Lodge Fraternal Order of Police, Inc., shall receive 70 percent of the net proceeds of the fee to be used for the purposes of the organization and the remainder of the net proceeds of the fee shall be distributed to the Alabama Peace Officer's Annuity and Benefit Fund to be used for the purposes of the fund.

(g) The Department of Revenue may promulgate rules to implement this act.

Section 2. All laws or parts of laws which conflict with this act are repealed.

Section 3. This act shall become effective on January 1, 2018, following its passage and approval by the Governor, or its otherwise becoming law.
