A BILL TO BE ENTITLED AN ACT

Relating to Macon County; to provide that the game of bingo authorized by Amendment 744 of the Constitution of Alabama of 1901, may be played on any electronic machine or device that is authorized by the National Indian Gaming Commission pursuant to the Indian Gaming Regulatory Act, 25 U.S.C § 2701 et seq., and which is operated by any Native American tribe in Alabama.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. The Legislature acknowledges that based upon the history of the times, the existing order of things, the state of the law when Amendment 744 of the Constitution of Alabama of 1901, was adopted, and the conditions necessitating such adoption, the voters in Macon County and the Legislature intended to and did authorize the Sheriff of Macon County to promulgate rules and regulations for the licensing and operation of bingo games in Macon County including bingo games to be played on paper, machines, or electronic devices.

Section 2. For the purposes of Amendment 744, the Legislature ratifies and confirms that the game of bingo may be played on any electronic machine or electronic device authorized by the National Indian Gaming Commission pursuant to the Indian Gaming Regulatory Act, 27 U.S.C. § 2701 et seq., and which is operated by any Native American tribe in Alabama. Section 8-1-150, Sections 13A-12-20 to 13A-12-27, inclusive, and Section 13A-12-30 of the Code of Alabama 1975, shall not apply to any bingo game authorized by this provision and operated in accordance with the rules and regulations promulgated by the Sheriff of Macon County pursuant to Amendment 744.

Section 3. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.
