A BILL TO BE ENTITLED AN ACT

Relating to Tuscaloosa County; to amend Section 3 of Act 85-106 of the 1985 Regular Session (Acts 1985, p. 135), relating to Tuscaloosa County Commission and specifying that the judge of probate also serves as chair of the commission; to further provide that a person serving as judge of probate and chair of the county commission may elect to resign from the position of judge of probate and continue to serve as chair of the county commission; and to provide the chair of the county commission would be elected countywide thereafter.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. Section 3 of Act 85-106 of the 1985 Regular Session (Acts 1985, p. 135), is amended to read as follows:

"Section 3. (a) The chairman of said Subject to subsection (b), the chair of the county commission shall be the Probate Judge of Tuscaloosa County, and he or she shall preside at all meetings of the county commission at which he or she is present, and he or she shall be entitled to vote on all or any matters coming before the county commission in like manner as other county commissioners. The Probate Judge of Tuscaloosa County shall continue to be elected and serve as otherwise provided by the laws of the State of Alabama.

"(b) In the event an elected judge of probate of the county who, pursuant to subsection (a), at the same time was also elected to serve as the chair of the county commission, submits a statement in writing to the Governor that he or she resigns his or her position as judge of probate, but elects to continue to serve as chair of the county commission, upon the acceptance of his or her resignation by the Governor, the person shall continue to serve as chair of the county commission, shall continue to receive the same salary, and shall serve for the remainder of the term for which he or she was elected except as provided herein. A successor to the position of chair of the county commission shall be elected from the county at-large at the general election in November of the year immediately preceding the end of term for which the person was originally elected to the joint position of judge of probate and chair and the successor to the chair shall take office at the same time as the other members of the county commission and shall serve the same term as the other members of the county commission. The chair of the county commission elected pursuant to this subsection shall receive an annual salary of one hundred five thousand dollars ($105,000) payable from the general fund of the county."

Section 2. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.
