A BILL TO BE ENTITLED AN ACT

Relating to the City of Vestavia Hills located in parts of Shelby and Jefferson Counties; to provide for a warrant recall fee to allow a municipal magistrate or municipal judge for the City of Vestavia Hills to recall, under certain conditions, a failure to appear warrant.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) Notwithstanding any law to the contrary, a municipal judge or municipal magistrate of the City of Vestavia Hills, Alabama, may assess a defendant with a warrant recall fee that shall be paid in order for a municipal judge or magistrate to recall a failure to appear warrant arising from any municipal ordinance violation against the City of Vestavia Hills.

(b) The warrant recall fee shall be one hundred dollars ($100) and is to be paid by the defendant at the time the warrant is recalled.

(c) Nothing herein shall be construed to require the City of Vestavia Hills to recall a warrant that has been issued. All orders to recall a warrant shall be issued solely in the discretion of the municipal judge or magistrate.

Section 2. All fees received by the City of Vestavia Hills Municipal Court for the warrant recall fee shall be deposited into the City of Vestavia Hills Corrections Fund and allocated in conformity with subsection (a) of Section 11-47-7.1 of the Code of Alabama 1975.

Section 3. The provisions of this act are severable. If any part of this act is declared invalid or unconstitutional, that declaration shall not affect the part which remains.

Section 4. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.
