A BILL TO BE ENTITLED AN ACT

Relating to Coffee County; to further provide for the salaries of a county commissioner and the incumbent Revenue Commissioner; to amend Section 45-16-62, Code of Alabama 1975, to further provide for the compensation of the coroner; to amend Section 45-16-84.01, Code of Alabama 1975, to further provide for the salary of the judge of probate; to amend Section 45-16-84.02, to further provide for the salary of the Revenue Commissioner; to amend Section 45-16-230, Code of Alabama 1975, to further provide for the compensation of the sheriff; and to repeal Sections 45-16-60 and 45-16-84, Code of Alabama 1975, relating to the expense accounts of the judge of probate and the coroner.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) Each member of the Coffee County Commission who is first elected or appointed on or after the effective date of this act shall receive an annual base salary of twenty-two thousand five hundred dollars ($22,500).

(b)(1) The annual salary provided in subsection (a) shall continue to be adjusted thereafter as authorized in Chapter 2A, Title 11, Code of Alabama 1975.

(2) If there is a break in continuous service as commissioner on or after the effective date of this act, upon reappointment or reelection as a commissioner, he or she shall receive the base salary as provided in subsection (a), which may be adjusted as provided in subdivision (1).

(c) The Chair of the Coffee County Commission shall receive an annual stipend in the amount of five thousand dollars ($5,000), which shall not be included when calculating an increase in compensation under Chapter 2A, Title 11, Code of Alabama 1975.

Section 2. (a) The annual salary of the incumbent Revenue Commissioner of Coffee County holding office on the effective date of this act shall be ninety-two thousand, five hundred dollars ($92,500).

(b) The annual salaries provided in subsection (a) shall continue to be adjusted thereafter as authorized in Chapter 2A, Title 11, Code of Alabama 1975.Section 3. Sections 45-16-62, 45-16-84.01, 45-16-84.02, and 45-16-230, Code of Alabama 1975, are amended to read as follows:

§45-16-62.

"(a) This section shall only apply in Coffee County.

"(b) At the expiration of the current term of office of the Coroner of the Elba Division and the Coroner of the Enterprise Division of the county, or if a vacancy occurs in either division in the office of coroner, then immediately upon the occurrence of the vacancy, the Elba Division of Coroner and the Enterprise Division of Coroner shall cease to exist and the office of Coroner of Coffee County is established. The Coroner of the Elba Division and the Coroner of the Enterprise Division, as the case may be, remaining in office shall be the Coroner of Coffee County for the remainder of the term of office for which he or she was elected. If the vacancy occurs as a result of the expiration of the term of office, the coroner elected at the general election by majority vote shall be the Coroner of Coffee County. (a) The coroner shall be elected at the general election and every four years thereafter, and shall serve for a term of four years.

"(c) (b) The coroner shall appoint a chief deputy coroner from the judicial circuit division of the county where the elected coroner does not reside.

"(d)(1) Commencing August 1, 2008, the Coroner of the Elba Division and the Coroner of the Enterprise Division shall each receive one-half of an expense allowance that is the salary of a member of the Coffee County Commission, but not less than eighteen thousand dollars ($18,000) annually. This expense allowance shall be in lieu of any and all other compensation, salary, and expense allowance provided by law.

"(2) (c)(1) Beginning at the next term of office, the A Coroner of Coffee County who is first elected or appointed on or after the effective date of the act adding this amendatory language shall receive the same salary as a member of the Coffee County Commission, but not less than eighteen thousand dollars ($18,000) an annual base salary of twenty-five thousand dollars ($25,000) per year, which shall be paid in the same manner and at the same time as other county employees.

"(2) The annual salary provided in subdivision (1) shall continue to be adjusted thereafter as authorized in Chapter 2A of Title 11.

"(3) If there is a break in continuous service as coroner on or after the effective date of this act, upon reappointment or reelection as coroner, he or she shall receive the base salary as provided in subdivision (1), which may be adjusted as provided in subdivision (2).

"(3) (d) The coroner may participate in the same retirement system and the same insurance plan in the same manner and upon the same terms and conditions as any other employee of the county.

"(e) Beginning upon a vacancy in the Elba Division of Coroner or the Enterprise Division of Coroner pursuant to subsection (b), the chief deputy coroner shall receive a salary of two hundred dollars ($200) per month and any and all expenses incurred by the chief deputy coroner in the performance of the duties of the office of Coroner of Coffee County in the absence of the coroner.

"(f) (e) The Coffee County Commission shall pay all expenses incurred or required by the coroner and chief deputy coroner to perform the duties of his or her office, including travel expenses pursuant to state-approved rates for state employees, radio and paging equipment and maintenance costs, and association dues and continuing education expenses. The expenses shall be paid from the county general fund by the county commission.

§45-16-84.01.

"(a) At the beginning of the next term of office, the A Judge of Probate of Coffee County who is first elected or appointed on or after the effective date of the act adding this amendatory language shall receive an annual base salary of forty thousand dollars ($40,000) seventy-five thousand dollars ($75,000) per year. The Except as provided in subsection (b), the salary shall constitute the total compensation payable to the judge of probate, and shall be in lieu of any salary, expense allowance, or other compensation heretofore provided by law. The judge of probate shall be paid from the same funds and in the same manner as presently provided.

"(b) The annual salary provided in subsection (a) shall continue to be adjusted thereafter as authorized in Chapter 2A of Title 11.

"(c) If there is a break in continuous service as judge of probate on or after the effective date of this act, upon reappointment or reelection as judge of probate, he or she shall receive the base salary as provided in subsection (a), which may be adjusted as provided in subsection (b).

§45-16-84.02.

"(a) At the beginning of the next term of office, the A Revenue Commissioner of Coffee County elected on or after the effective date of the act adding this amendatory language shall receive an annual base salary of forty thousand dollars ($40,000) seventy-five thousand dollars ($75,000) per year. The Except as provided in subsection (b), the salary shall constitute the total compensation payable to the revenue commissioner, and shall be in lieu of any salary, expense allowance, or other compensation heretofore provided by law. The revenue commissioner shall be paid from the same funds and in the same manner as presently provided.

"(b) The annual salary provided in subsection (a) shall continue to be adjusted thereafter as authorized in Chapter 2A of Title 11.

"(c) If there is a break in continuous service as revenue commissioner on or after the effective date of this act, upon reappointment or reelection as revenue commissioner, he or she shall receive the base salary as provided in subsection (a), which may be adjusted as provided in subsection (b).

§45-16-230.

"At the beginning of the next term of office, the A Sheriff of Coffee County elected or appointed on or after the effective date of the act adding this amendatory language shall receive an annual salary of forty thousand dollars ($40,000) seventy-five thousand dollars ($75,000) per year. The Except as provided in subsection (b), the salary shall constitute the total compensation payable to the sheriff, and shall be in lieu of any salary, expense allowance, or other compensation heretofore provided by law. The sheriff shall be paid from the same funds and in the same manner as presently provided.

"(b) The annual salary provided in subsection (a) shall continue to be adjusted thereafter as authorized in Chapter 2A of Title 11."

(c) If there is a break in continuous service as sheriff on or after the effective date of this act, upon reappointment or reelection as sheriff, he or she shall receive the base salary as provided in subsection (a), which may be adjusted as provided in subsection (b).

Section 4. Section 45-16-84, Code of Alabama 1975, relating to the compensation of the Judge of Probate of Coffee County and Section 45-16-60, Code of Alabama 1975, relating to the expense allowance of the Coroner of Coffee County, are repealed.

Section 5. This act shall become effective on the first day of the first month following its passage and approval by the Governor, or its otherwise becoming law.
