A BILL TO BE ENTITLED AN ACT

Relating to the City of Lincoln in Talladega County; to alter, rearrange, and extend the boundary lines and corporate limits of the City of Lincoln in Talladega County; and to further provide for the police jurisdiction of the city.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) The boundary lines and corporate limits of the City of Lincoln in Talladega County are altered, rearranged, and extended to include within the corporate limits of the municipality, in addition to the lands now included, all of the following territory:

Located in Section 28, Township 17 South, Range 4 East, Talladega County, Alabama, being more particularly described as follows:

Lots 4 and 5, Riverview Lane Subdivision, a plat of which is recorded in the Office of the Judge of Probate for Talladega County, Alabama, in Slide 229, at page 263.

(b) The annexation by this section shall not affect or extend the police jurisdiction of the City of Lincoln.

Section 2. When property is annexed or has been annexed to the City of Lincoln and the property is not contiguous to the main body of the city, the annexation shall not affect the police jurisdiction of the city, and the police jurisdiction of the city shall extend only from the main body of the city.

Section 3. This act is enacted pursuant to the plenary authority of the Legislature to alter or rearrange the boundaries of a city or town pursuant to subdivision (18) of Section 104 of the Constitution of Alabama of 1901.

Section 4. If any part of this act is declared invalid or unconstitutional, the annexation in subsection (a) of Section 1 shall be null and void.

Section 5. In accordance with Section 11-42-6(b) of the Code of Alabama 1975, a map showing what territory is proposed to be annexed to the City of Lincoln is on file in the office of the Judge of Probate in Talladega County, Alabama, and the map is open to the inspection of the public.

Section 6. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
