ENROLLED, An Act,

Relating to Washington County; to amend Section 2 of Act 95-220 of the 1995 Regular Session (Acts 1995, p. 384), providing for the assessment of an additional fee on all documents submitted for recording in the office of the judge of probate which are subject to a deed or mortgage tax; to create the Washington County Probate Judge Fund; and to further provide for the disposition of fees.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. Section 2 of Act 95-220 of the 1995 Regular Session (Acts 1995, p. 384) is amended to read as follows:

"Section 2. The Washington County Probate Judge Fund is created in the county treasury. The funds generated from the additional recording fee levied by this act, and any interest earned thereon, shall be deposited into the Washington County Probate Judge Fund on a monthly basis and shall be used only by the judge of probate, in his or her sole discretion, for the operation of the office of the judge of probate, including, but not limited to, the digitalization of records, acquiring, updating, and replacing existing technology, and for the use of the office of the judge of probate for recordkeeping purposes."

Section 2. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.
