SYNOPSIS: Under existing law, Jacksonville State University is under the management of a board of trustees.

This bill would revise the membership of the board.

This bill would decrease term length for trustees from 12 to six years.

This bill would also specify that a trustee who turns 70 years old may finish his or her term of office.

A BILL TO BE ENTITLED AN ACT

To amend Section 16-52-3, Code of Alabama 1975, relating to Jacksonville State University; to revise the membership of the board; to decrease term length from 12 to six years; and to specify that a trustee who turns 70 years old may serve until the expiration of his or her term of office.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:Section 1. Section 16-52-3 of the Code of Alabama 1975, is amended to read as follows:

ยง16-52-3.

"(a) There is created a Board of Trustees for Jacksonville State University, the state educational institution formerly known as Jacksonville State College at Jacksonville, Alabama.

"(b) The board of trustees shall consist of two members from the congressional district in which the institution is located, one from each of the other congressional districts in the state, one at-large member, the State Superintendent of Education from the state, one at-large member from outside of the state, and the Governor, who shall be ex officio president of the board.

"(c) The trustees shall be appointed by the Governor, by and with the advice and consent of the Senate and, except for the first trustees appointed commencing on the effective date of the act amending this section, shall be appointed to hold office for a term of 12 six years and until their successors shall be appointed and qualified. Of the first members appointed to the board, one third shall be appointed for terms of four years, one third for terms of eight years and one third for terms of 12 years. The at-large member shall be appointed for both initial and succeeding terms of 12 years and until a successor is appointed and qualified in the same manner as other members No trustee shall be appointed to serve more than a total of three full terms.

"(d) No trustee shall receive any pay or emolument other than his or her actual expenses incurred in the discharge of his or her duties as such.

"(e) A trustee who has attained the age of 70 years during a term of office may continue to serve until the expiration of that term. A trustee who has departed the board and who has attained the age of 70 years or older may be designated by the board as a Trustee Emeritus and may receive such honorary privileges as conferred by the board.

"(f) No employee of Jacksonville State University shall be eligible to serve on its board of trustees."

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
