ENROLLED, An Act,

Relating to Houston County; to authorize the sale of certain alcoholic beverages on certain days and providing for a referendum.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. This act shall only apply in Houston County.

Section 2. (a) Subject to the provisions of Section 3, and except as otherwise provided in subsection (b), the sale of alcoholic beverages for off-premises consumption on Sundays between the hours of 1:00 P.M. and midnight is authorized within Houston County by properly licensed retail licensees of the Alcohol Beverage Control Board.

(b) Any municipality in Houston County except the City of Dothan, by ordinance or resolution of the municipal governing body, may opt out of the provisions of subsection (a).

Section 3. The Judge of Probate of Houston County shall hold a referendum at the next regularly scheduled countywide election to determine if alcoholic beverages for off-premises consumption may be sold on Sundays in Houston County. The election shall be held in the manner provided by law for holding other county elections, and the returns thereof tabulated and results certified as provided by law for county elections. The judge of probate shall cause the following language to appear on the ballot: "Do you favor the legal sale and distribution of alcoholic beverages for off-premises consumption within Houston County on Sunday after 1:00 P.M. as provided in Act _____ of the 2015 Regular Session? Yes ___, No ___." If a majority of the qualified voters voting thereon in the county vote in favor of the question, then the sale of alcoholic beverages for off-premises consumption on Sunday shall be authorized as provided in this act.

Section 4. This act shall not affect any other law relating to the sale of alcoholic beverages in Houston County.

Section 5. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.
