A BILL TO BE ENTITLED AN ACT

To authorize fishing with a gill, trammel, or similar net in the Tennessee River and its tributaries; and for this purpose to amend Section 9-11-88, Code of Alabama 1975, to delete provisions prohibiting fishing with a gill, trammel, or similar net on the Tennessee River and its tributaries.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) A person, at any time, day or night, During daylight hours, a person may take, catch, capture, or kill any game or nongame fish by use of a gill, trammel, or similar net in the Tennessee River and its tributaries.

(b) The Commissioner of the Department of Conservation and Natural Resources may adopt reasonable rules not in conflict with this section necessary to implement this section.Section 2. Section 9-11-88, Code of Alabama 1975, is amended to read as follows:

"(a) It shall be unlawful for any person to take, catch, capture, or kill any game or nongame fish by use of a gill, trammel, or similar type net in the waters impounded by Jordan Dam, Lay Dam, Mitchell Dam, and Martin Dam. Whoever violates this subsection is guilty of a misdemeanor and, upon conviction, shall be punished as prescribed by law.

"(b) It shall be unlawful for any person to take, catch, capture, or kill any game or nongame fish by use of a gill, trammel, or similar type net in that part of the Tennessee River lying within the boundaries of Alabama and all tributaries thereto. Any person violating this subsection shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than two hundred fifty dollars ($250) nor more than five hundred dollars ($500), or by imprisonment in the county jail for six months, or by both a fine and imprisonment."

Section 3. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.
