SYNOPSIS: Under existing law, lotteries and gift enterprises are prohibited.

This bill would propose an amendment to the Constitution of Alabama of 1901, to allow Shoals Scholar Dollars, Incorporated, to conduct a raffle to raise funds for college scholarships for residents of Lauderdale County; to allow the Lauderdale County Commission to establish rules regarding the operation of the raffle; to require compliance with the rules established by the Lauderdale County Commission; to allow the commission to examine the raffle at any time and issue cease and desist orders; and to require Shoals Scholar Dollars, Incorporated, to maintain certain records.

A BILL TO BE ENTITLED AN ACT

Proposing an amendment to the Constitution of Alabama of 1901, to allow Shoals Scholar Dollars, Incorporated, to conduct a raffle to raise funds for college scholarships for residents of Lauderdale County; to allow the Lauderdale County Commission to establish rules regarding the operation of the raffle; to require compliance with the rules established by the Lauderdale County Commission; to allow the commission to examine the raffle at any time and issue cease and desist orders; and to require Shoals Scholar Dollars, Incorporated, to maintain certain records.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:Section 1. The following amendment to the Constitution of Alabama of 1901, is proposed and shall become valid as a part of the Constitution when all requirements of this act are fulfilled:

PROPOSED AMENDMENT

(a)(1) Notwithstanding any law to the contrary, Shoals Scholar Dollars, Incorporated, may conduct a raffle to raise funds for college scholarships for residents of Lauderdale County.

(2) Shoals Scholar Dollars, Incorporated, shall conduct a savings promotion raffle so that each token or ticket representing an entry in the raffle has an equal chance of being drawn.

(b) The Lauderdale County Commission shall promulgate rules for the conduct of the raffle, and the Shoals Scholar Dollars, Incorporated, shall operate the raffle pursuant to those rules.

(c) Shoals Scholar Dollars, Incorporated, shall maintain records sufficient to facilitate an audit of the raffle.

(d) The Lauderdale County Commission may examine the conduct of the raffle at any time and may issue a cease and desist order for a violation of the rules.

Section 2. An election upon the proposed amendment shall be held in accordance with Amendment 555 to the Constitution of Alabama of 1901, now appearing as Section 284.01 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, and the election laws of this state.

Section 3. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment:

"Relating to Lauderdale County, proposing an amendment to the Constitution of Alabama of 1901, to allow Shoals Scholar Dollars, Incorporated, to conduct a raffle to raise funds for college scholarships for residents of Lauderdale County; to allow the Lauderdale County Commission to establish rules regarding the operation of the raffle; to require compliance with the rules established by the Lauderdale County Commission; to allow the commission to examine the raffle at any time and issue cease and desist orders; and to require Shoals Scholar Dollars, Incorporated, to maintain certain records.

"Proposed by Act _________"

This description shall be followed by the following language:
